This is the privacy policy of Uplevelling With Joy.  In this document, “the Company”, “we”, “our”, or “us” refers to Uplevelling With Joy (TM), ABN 47070208460.

1.     Introduction

This Privacy Policy governs your access to and use of uplevellingwithjoy.com, including any content, functionality and services offered on or through uplevellingwithjoy.com (the "Website"), whether as a guest or a registered user.

When accessing this Website, the Company will learn certain information about you, both automatically and through voluntary actions you may take, during your visit. This policy aims to inform you about how we collect and handle any information that we collect from you, or that you provide to us. It covers both information that could identify you (“personal information”) and information that could not.

Except as set out below, we do not share, or sell, or disclose to a third party, any personally identifiable information collected at this Website.

2.2.2  in a collective way not referable to any particular individual, for the purpose of quality control and improvement of our Website;

In compliance with the CAN-SPAM Act, all e-mails sent from us will clearly state who the e-mail is from and provide clear information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us.  Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the e-mail.  If you have trouble unsubscribing, you can send an email to office@uplevellingwithjoy.com requesting to unsubscribe from future emails.

If you are outside the European Union and opt to receive any free resources, participate in any free training programs, register for a webinar, register for a live event, register for a seminar, or purchase any products sold by the Company on this Website, we will automatically enrol you to receive our free email newsletter. If you do not wish to receive this newsletter, you can unsubscribe anytime by clicking on the unsubscribe link at the bottom of every email we send.

2.3  Information you post on our website

This is information you post to a forum or blog. We reserve the right to use it for marketing or other purposes.

2.1  Your website usage

This is information about your IP address, operating system, browser type, the pages you view, how you have reached them, what you do when you visit a page, the length of time you remain on the page, and how we perform in providing content to you.

2.4  Financial information relating to your credit cards

This information is never taken by us either through our Website or otherwise. At the point of payment, you are transferred to a secure page on the website of Stripe, Paythen or other reputable payment service provider. Your payment transactions through these payment service providers will be encrypted.  The payment page may be dressed in our “livery”, but it is not controlled by us. Our staff and contractors never have access to it.

Note on padlock symbols and other trust marks: Many companies offer certification and an icon or other small graphic to prove to website visitors that the site is safe. We do not handle information about your credit card so do not subscribe to any such service.

2.5   Financial information about your direct debit

When you have agreed to set up a direct debit arrangement, the information you have given to us is passed to our own bank, for processing according to our instructions. We may keep a copy.

2.6  Affiliate information

This is information given to us by you in your capacity as an affiliate of us or a customer or client of ours. Such information is retained for business use only. We undertake to preserve the confidentiality of the information and of the terms of our relationship. It is not used for any other purpose. We expect any affiliate to agree to reciprocate this policy. As an exception to this, we have the right to disclose your first name and URL of your affiliate connection to other affiliates and to any other person or organisation, on and off site. The reason is solely to enable us to mention winners and others whose performance as an affiliate is in some way outstanding.

2.7  Information from third parties

This is data which is indirectly made up from your personal information, from software services such as Google Analytics and others. No such information is identifiable to you.

3.    How we use your information

This information is retained so that we can serve your information to you when you return to the website.   • enable you to watch videos we have placed on YouTube. YouTube will not store personally identifiable cookie information when you use YouTube’s privacy-enhanced mode.

4.1  our subsidiaries, affiliates and service providers for the purpose of providing our services to you;

4.2  a third party, including a lawyer, collection agency or credit reference agency, when necessary to enforce our terms of service or any other agreement between you and the Company;

4.3  any successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets and/or business;

4.4  legal authorities if they so request or have the proper authorisation such as a search warrant or court order.

5.    Viewing by others

Whenever you make your personal information or other information available for viewing by others such as through our community platforms, the personal information or other information that you share can also be seen, collected, and used by others. Therefore, we cannot be responsible for any unauthorised use by others of such personal information or other information that you voluntarily share online or in any other manner.

6.    Use of site by children

We do not market to children, nor do we sell products or services for purchase by children. If you are under 16 you may use our Website only with consent from a parent or guardian. 

We do not knowingly collect or use personal data from children under 16 years of age.  If we learn that we have collected personal data from a child under 16 years of age, the personal data will be deleted as soon as possible.  If a child under 16 years of age has provided us with personal data, their parent or guardian may contact our office.

7.    GDPR

For users in the European Union, we adhere to the Regulation (EU) 2016 679 of the European Parliament and of the Council of 27 April 2016, known as the General Data Protection Regulation (the “GDPR”). 

For users in the United Kingdom, we adhere to the GDPR as enshrined in the Data Protection Act 2018. 

We have not appointed a Data Protection Officer as we do not fall within the categories of controllers and processors required to appoint a Data Protection Officer under Article 37 of the GDPR.

8.    Data may be processed outside Australia

Our Website is hosted in the United States of America. We also use outsourced services in countries outside Australia from time to time in other aspects of our business.  Accordingly data obtained within Australia may be processed outside Australia and data obtained in any other country may be processed within or outside that country.

9.    How we protect your data

In order to protect your privacy, we store all of our data on servers in secure facilities. 

Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, the Company cannot ensure or warrant the security of any information you transmit via the internet. By transmitting any such information to the Company, you accept that you do so at your own risk.

Email:  Email is not recognized as a secure medium of communication and we therefore request that you do not send private information to us by email. If you do, it is at your own risk.

Passwords:  Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share the password with anyone.

10.   Complaints procedure

10.1  If you have a complaint about how we have collected or handled your personal information, please contact us at office@uplevellingwithjoy.com. We will endeavour in the first instance to deal with your complaint and take action to resolve the matter.

10.2  If your complaint cannot be resolved at the first instance, we will ask you to lodge a formal complaint in writing, explaining the circumstances of the matter that you are complaining about, how you believe your privacy has been interfered with and how you believe your complaint should be resolved.  We will acknowledge receipt of your formal complaint and indicate the timeframe that you can expect a response. We will endeavour to resolve the complaint as quickly as possible, but if the matter is complex and our investigation may take longer, we will let you know when we expect to provide our response.
